There is a lot of good ground on both sides of the courts topic albeit somewhat generic.   
 
You are right that on both aff and neg there will be critical debates--Obviously CLS, CRT, Rights debates etc. but there is still room for good old fasion throw downs such as:
 
Negative:
Hollow Hope DA
Legitimacy DA
Judicial Activism DA
Politics (inevitable despite possibly sketchy link stories)
Judicial Federalism
Morgan Powers CP
States / Lopez CP
Congress CP
Exec CP
Courts Bad
Also a lot of specific neg to the details of each case
 
Aff:
Federalism throw down
Modelling?
Abortion?
Economy?
Read the topic paper and you'll see each case and you probably could get an idea from that.
